What is a Diversion?
A diversion is a contract that you enter into with the District Attorney's Office. If the terms of Diversion are fulfilled the District Attorney will dismiss the charges. Should you fail to fulfill the terms of Diversion, the District Attorney will revoke the Diversion. The matter will then proceed to a bench trial on stipulated facts and, if convicted, you will be sentenced by the Court.
Not all offenses are eligible for diversion.
- Eligibility depends on the circumstances of the offense and your criminal history.
Time is of the essence in applying for Diversion and unnecessary or unreasonable delays in applying may affect your eligibility.
- The District Attorney agrees to one continuance of your court date to allow you to apply for diversion.

If the offense involves traffic infractions and you wish to apply for a diversion, DO NOT pay your ticket immediately. Payment on a traffic ticket results in a conviction being entered and Diversion would no longer be an option.
